"Mint", "Mint Academy", "us", "we" or "our" refers to M&D Barbers Ltd, trading as Mint, of 175 Old Christchurch Road, Bournemouth, BH1 1JU. "You" or "your" refers to the visitor, user, student or model using this website or our services.

These Terms are split into three parts. Part A covers general use of this website. Part B covers bookings and attendance on our Academy courses. Part C covers models attending Academy sessions. If you are booking or attending a course, Parts A and B apply to you. If you are attending as a model, Parts A and C apply to you.

Part A: Website Terms of Use

Welcome to the website for Mint. By using this website, you agree to comply with the following terms and conditions of use. These terms, together with our Privacy Policy, govern the relationship between Mint and you in relation to this website. If you disagree with these terms and conditions, please do not use our website. By using this site, you agree to the following: all information and content listed on this website is for general information use only, and is subject to change at any time without prior notice. We use cookies on this website to monitor the browsing preferences of visitors and users, and if you agree to cookies being stored, that information may be stored by us for use by external third parties. We, and any related third parties, give no guarantee or warranty as to the performance, exactness, accuracy or appropriateness of the resources or materials offered on this website for any specific purpose. By using this website, you accept that materials and information may occasionally be inaccurate or contain errors, for which we exclude liability to the fullest extent permitted by law. Your use of materials or information sourced from this website is at your own risk, and it is your responsibility to ensure that any information, services or products offered via our website meet your needs. All materials on this website are either owned by, or licensed to, Mint, including but not limited to graphics, appearance, design and layout, and reproduction of these materials is strictly prohibited unless expressly permitted under a notice of copyright forming part of these terms. All trademarks reproduced on this website which are not the property of, or licensed to, Mint are acknowledged, and unauthorised use of this website may be a criminal offence and/or may give rise to a claim for damages. We may place external third-party links on our website for the convenience and benefit of users, and such links do not imply an endorsement by Mint of those websites, nor do we accept responsibility for the content of any third-party linked website. Your use of this website, and any dispute arising from such use, is governed by the laws of England and Wales.

Part B: Academy Course Terms & Conditions

These Terms, in addition to Part A above and our Privacy Policy, together with any booking form provided by us, apply to the purchase of our Courses. Please read these Terms carefully before booking a Course. This contract sets out your legal rights and responsibilities, our legal rights and responsibilities, and certain key information required by law. These Terms form the basis of any contract between M&D Barbers Ltd ("Mint", "we", "us", "our") and you ("Student", "you", "your").

Definitions. In these Terms, "Bookings" means the online, phone or in-person booking of any Course with us, confirmed by payment of the Fee into our bank account, or by any other payment method agreed between us, and our Confirmation Email. "Business" means any business, trade, craft or profession carried on by you or any other person or organisation. "Confirmation Email" means the email sent to you confirming your offer to purchase a Course from us. "Consumer" means a consumer as defined by the Consumer Rights Act 2015, meaning any individual customer of ours. "Course" means the in-person Mint Academy barbering course and diploma, and/or any online courses offered by us, whichever is purchased by you. "Course Start Date" means the start date for your Course, as notified to you by us. "Course End Date" means the end date for your Course, as notified to you by us. "Course Materials" means any course materials provided by us to you, which may include online tutorials, downloads and other materials. "Fee" means the fee payable for the Course, inclusive of VAT. "Enquiry" means any interaction between us and you prior to any purchase of our services. "Price List" means our standard price list for our Courses, available at mintbarbershops.co.uk. "Student", "you" or "your" means the individual recipient of tuition on our Course. "Tuition" means the tuition and associated activities provided through our Course by way of lessons. "Website" means mintbarbershops.co.uk. Unless the context otherwise requires, headings are for convenience only and do not affect interpretation, the singular includes the plural and vice versa, and references to any gender include the other gender.

Bookings. Bookings can be made only by contacting us directly in person, by phone, or through our Website. You must read and accept these Terms before making a Booking. When you make an Enquiry or place an order for a Course, whether via the Website, by email or by telephone, you are offering to purchase that Course on these Terms, and we reserve the right to decline or cancel your order. A Booking is only confirmed once you make payment and we send you a Confirmation Email, at which point a contract comes into existence between you and us on these Terms. We will notify you of the Course Start Date and Course End Date. If we are unable to offer Tuition or confirm a Booking, we will inform you, and will use reasonable endeavours to provide lessons at the agreed times. We may from time to time request a deposit on a Booking, and will notify you where this applies. During Courses we may supply models for the benefit of students, but we do not guarantee the provision of any model, or how many will be available.

Lessons and your obligations. Our Courses are hands-on and designed to be suitable for complete beginners, with a diploma awarded on successful completion. Students must pass the Course to receive the diploma. We will tutor in the way we consider most likely to help you achieve your aims, and we require you to advise us of your objectives from the outset. We will make reasonable endeavours to tutor you, but are not responsible for errors made by you or your failure to pass the Course. You must provide a postal address for administrative purposes, a current email address for routine correspondence, and a contact phone number for non-routine correspondence. If you are under 18, your parents must also provide a primary emergency contact, a secondary emergency contact, and details of any relevant health issues, including guidance on prescribed medication. Participants must adhere fully to health and safety guidelines and follow instructions given. If, due to exceptional circumstances such as illness, accidents or bereavement, you cannot attend a scheduled lesson, we will, at our discretion and where possible, offer the opportunity to catch up. If we need to cancel a lesson, including because it falls on a bank holiday, we may do so without liability to you, but will, at our discretion, offer a catch-up opportunity. We expect good behaviour at our Academy, and by accepting these Terms, you agree not to bring our business and reputation into disrepute. Bad behaviour or a breach of health and safety requirements may result in expulsion without refund.

Fees and payment. The Fee for any Course is set out in our Price List or on our Website and includes VAT. Payment can be made by bank transfer, debit card or credit card. If payment fails, you cannot start the Course. Deposits are non-refundable. Fees are non-refundable and non-transferable except where required by law.

Cancellation rights. You may cancel within 14 days under the Consumer Contracts Regulations. If tuition has not started, you will receive a refund. If tuition has started, cancellation rights may be lost. Refunds are made using the same payment method used for the original payment.

Liability. These Terms relate to Consumers. Nothing in these Terms excludes or limits your legal rights, and advice on your legal rights is available from your local Citizens Advice Bureau. This clause sets out our entire financial liability to you in respect of all losses, claims or liabilities arising from or in respect of these Terms, including any Tuition services you receive from us, whether in contract, tort, breach of statutory duty, or otherwise. We provide tuition only for your personal and private use, and are not liable to you for any loss of profit, loss of business, loss of revenue, loss of savings, interruption to business, or loss of business opportunity, nor do we accept responsibility for damage to or loss of property howsoever caused. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Our total liability to you in respect of all liabilities and losses connected with these Terms will not exceed the value of the Fee paid by you or on your behalf, less any fees due for Tuition already delivered. We are not responsible for any failure or delay in performance of our obligations caused by an event outside our control, meaning any act or event beyond our reasonable control including, but not limited to, strikes or industrial action, civil commotion, terrorist attack or threat of terrorist attack, epidemic, adverse weather or other natural disasters, and this does not affect your statutory rights. Where models are used during lessons, we will supervise you to the level of your ability, but we are not liable to you or the models for any loss or damage suffered as a result of our provision of services under these Terms.

Intellectual property. We own the intellectual property rights in our Courses, in any content supplied via Google Classroom, in the Mint Academy brand, and in any Course Materials supplied by us. All copyright, trade marks and other intellectual property rights in our literature, Website and Tuition remain vested in us at all times, and you may only use this material with our express consent. We reserve the copyright in any in-house Course Material, knowledge and know-how, and use of this material by Students outside the Tuition framework requires our written permission and must not be used for any purpose other than the Tuition. We grant you a revocable, non-transferable licence to use any Course Materials supplied to you for your own personal use. You may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post or otherwise make available any Course Materials, knowledge or know-how supplied to you.

Changes to these Terms. We may change these Terms from time to time without giving prior notice, but will use reasonable endeavours to inform you as soon as reasonably possible of any such changes.

How we use your personal information. We ensure that any use of data complies with all applicable legislation and regulatory requirements relating to the use of personal data, including the Data Protection Act 2018 and the UK GDPR. You agree that we may process your personal data provided to us to perform our obligations and enforce our rights under these Terms, in accordance with our Privacy Policy.

Complaints. We would like to hear from you if you have any cause for complaint. We are confident we can resolve genuine complaints quickly and informally, and ask that you discuss any concern with us before seeking to bring legal action against us.

General. No failure or delay by either party in exercising any right under these Terms operates as a waiver of that right, and no waiver of a breach of any provision means either party waives any subsequent breach of the same or any other provision. This contract is solely between you and us, and no other person has the right to enforce any of its terms. We reserve the right to recover any reasonable debt recovery charges connected with these Terms. These Terms, and any documents referred to in them, constitute the entire agreement between us and you, superseding any previous arrangements, understandings or agreements, whether written or oral, relating to their subject matter. You may not assign or sub-contract your rights under these Terms to any third party without our written agreement, and we may assign, transfer or sub-contract our rights or obligations to any third party at our discretion, without further notice to you. Any notice to be served on us under these Terms is properly served if sent by prepaid post to our address, or by email, and this does not include service of court proceedings. A notice sent by post is deemed given on the day it was posted, subject to proof of postage, and a notice sent by email or via the Website is deemed served on the day it was sent, subject to a delivery receipt.

Termination. We may cancel these Terms and terminate your participation in your Course where, including but not limited to, you fail to pay any outstanding Fees, you commit gross misconduct, you cease to be able to live or study in the United Kingdom, or you commit a serious breach of these Terms.

Severance. If any provision of these Terms is held by a competent authority to be invalid or unenforceable, in whole or in part, the validity of the remaining provisions, and of the remainder of the provision in question, will not be affected.

Law and jurisdiction. These Terms, and the relationship between you and us, whether contractual or otherwise, are governed by and construed in accordance with English law. Any dispute, controversy, proceedings or claim between you and us relating to these Terms is subject to the jurisdiction of the courts of England and Wales.

Part C: Model Terms & Conditions

Mint is a training academy providing educational services to our students, and we reserve the right to decline to provide a haircut or other service at our discretion. As a model, you acknowledge that Mint cannot be held liable for any injuries, including those that are self-inflicted or caused by another staff member or student, during your participation. By agreeing to model for us, you consent to us taking photographs of your participation, which may be used on our social media channels and other online platforms, in accordance with applicable data protection laws and our Privacy Policy.
